1. Agreement to Terms
By accessing or using PlantCast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access or use the Service.
These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.
2. Description of Service
PlantCast is a plant care management application that provides:
- AI-powered plant identification
- Plant care scheduling and reminders (PlantCasts)
- Garden area management
- Plant care history and tracking
- Community features (optional)
- Cross-platform access (web, iOS, Android)
3. Account Registration
To use certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate, current, and complete
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Subscription Plans and Pricing
4.1 Free Tier
We offer a free tier that provides basic features of the Service. The free tier may have limitations on the number of plants, areas, or features available.
4.2 One-Time App Purchase
A one-time purchase option (Certified / app unlock) is available for $4.99 USD. This purchase provides access to premium features without a recurring subscription.
4.3 Subscription Plans
We offer subscription plans with the following pricing:
- Monthly Subscription: $1.99 USD per month
- Annual Subscription: $19.99 USD per year
Subscription plans automatically renew unless cancelled. You will be charged the applicable subscription fee at the beginning of each billing period.
4.4 Price Changes
We reserve the right to modify subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods. We will notify you of any price changes in advance.
4.5 App Store, Google Play, and checkout
Paid features may be purchased through the Apple App Store, Google Play, or web checkout we offer. For purchases processed through the App Store or Google Play, Apple or Google (as applicable) is the merchant of record for that transaction. The amounts in sections 4.2, 4.3, and 4.6 are U.S. dollar (USD) reference prices; the price you are charged may be displayed in local currency and may vary by storefront region according to the platformâs regional pricing, taxes, and exchange rates. Managing, canceling, or requesting refunds for those purchases is also subject to that platformâs rules. For purchases you complete on the web, PlantCast is the business you contract with for paid access to the Service (your subscription or other digital entitlement). Web checkout, receipts, and subscription-management tools may be provided using RevenueCat, Inc. billing services connected to our account. Payment processing for web purchases is handled by Stripe, Inc. as payment processor for PlantCast, unless a different payment processor is clearly identified on the checkout page or in your receipt or invoice. If the checkout page, your payment confirmation, or receipt identifies a different seller, payment processor, or merchant of record for the charge, that information controls for that transaction to the extent it differs from this section. USD amounts in sections 4.2, 4.3, and 4.6 remain reference prices only.
4.6 Add-on AI use packs
We may offer optional add-on AI use packs (for example, three hundred (300) additional plant identification uses for $1.99 USD per pack) through the App Store, Google Play, or web checkout. Unused purchased uses roll over and remain available on your account until consumed. Packs are separate from subscription allowances in section 4.3. If a pack purchase is refunded or revoked by the platform, we reduce your remaining add-on balance by the same number of uses that purchase had credited (not below zero). Pricing and availability may change; USD amounts here are reference prices only, consistent with section 4.5.
4.7 Cloud storage and device storage
If your plan includes online syncing, photos and other media may be stored on PlantCastâs servers (âcloud storageâ). Cloud storage is subject to per-account limits that we enforce on the server; when you reach your cap, new uploads to cloud storage may be refused until you delete content, free space, or purchase optional additional cloud storage. Each storage add-on is a one-time consumable purchase (currently 5 GB per pack; reference price USD $1.99, consistent with §4.5 pricing). Purchased capacity is permanent and accumulates alongside your subscription's base storage. A refund or chargeback that reverses a storage purchase will reduce your available balance by the credited amount; if the reversal causes your usage to exceed your adjusted cap, new uploads may be refused until usage is brought back within the new limit. Data kept only on your device or browser for offline use is separate: you set a local threshold in the app for reminders and warnings, and we do not apply the same server-side block to purely local storage. You remain responsible for storage on your own devices.
5. Refund and Cancellation Policy
5.1 Refund Policy
We offer a 30-day money-back guarantee for subscription purchases. If you are not satisfied with the Service within 30 days of your initial purchase, you may request a full refund. Refund requests must be submitted within 30 days of the purchase date.
One-time app purchases and add-on AI use packs (section 4.6) are generally non-refundable, except as required by applicable law or platform policies (e.g., Apple App Store, Google Play Store).
5.2 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until the end of your paid period.
We reserve the right to suspend or terminate your account and access to the Service if you violate these Terms.
6. User-Generated Content
6.1 Ownership
You retain ownership of all content you create, upload, or submit to the Service, including plant photos, notes, schedules, and other data ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to use, store, and display your User Content solely for the purpose of providing and improving the Service.
6.2 Community Contributions
User Content is for your own use unless you explicitly opt in to contribute to community features. If you choose to contribute your User Content to the community, you grant us and other users additional rights to use, view, and share that content as part of the community features.
6.3 Content Standards
You are solely responsible for your User Content. You agree not to upload, post, or transmit any content that:
- Violates any applicable laws or regulations
- Infringes on the rights of others (including intellectual property rights)
- Is harmful, threatening, abusive, or offensive
- Contains viruses or other malicious code
- Is spam or unsolicited commercial content
6.4 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we determine is harmful, inappropriate, or violates the rights of others. We are not obligated to monitor User Content but may do so at our discretion.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated systems (bots, scrapers) to access the Service without permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or alter any copyright, trademark, or other proprietary notices
8. Intellectual Property
8.1 Service Ownership
The Service, including its original content, features, and functionality, is owned by PlantCast and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
8.2 Trademarks
"PlantCast" and related logos and marks are trademarks of PlantCast. You may not use these trademarks without our prior written permission.
8.3 Third-Party Content
The Service may include content, features, or functionality provided by third parties (such as plant identification APIs). Such content is subject to the respective third parties' terms and conditions.
9. Disclaimers and Limitations of Liability
9.1 Service Availability
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
9.2 Plant Care Information
Plant care information, recommendations, and schedules provided by the Service are for informational purposes only. We do not guarantee the accuracy, completeness, or suitability of such information for your specific plants or conditions. You are solely responsible for the care of your plants and should consult with qualified professionals for critical plant care decisions.
9.3 Limitation of Liability
To the maximum extent permitted by applicable law, PlantCast and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.
9.4 Maximum Liability
Our total liability to you for all claims arising out of or relating to the use of or inability to use the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless PlantCast and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions.
12.2 Jurisdiction
Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Arizona, United States, and you hereby consent to the personal jurisdiction and venue of such courts.
12.3 Dispute Resolution
If you have any dispute with us, you agree to first contact us and attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree to submit the dispute to binding arbitration in Arizona, United States, in accordance with the rules of the American Arbitration Association.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the intent of the original provision.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlantCast regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations.
